Terms of Service

Please read these Terms carefully before using our website or engaging our services. By accessing www.my6.my or entering into a service agreement with My6 Initiative Berhad, you agree to be bound by these Terms.

01 Acceptance of Terms

By accessing or using the website at www.my6.my ("Website"), engaging our consultancy services, enrolling in training programmes, or otherwise doing business with My6 Initiative Berhad (ROC: 897128-T / 201001012897) ("My6", "we", "us", or "our"), you ("Client", "User", "you") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.

If you are accepting these Terms on behalf of a company, government agency, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

Important

If you do not agree to these Terms, you must not use our website or services. For government agencies, these Terms apply in addition to any formal service agreement or letter of engagement executed with My6 Initiative Berhad.

02 About My6 Initiative Berhad

My6 Initiative Berhad is a Malaysian company incorporated under the Companies Act 2016, bearing registration number 897128-T (201001012897). We are Malaysia's dedicated IPv6 centre of excellence, operating since 2010 with a mandate to drive IPv6 adoption, awareness, training, and technical standards development across Malaysia and the ASEAN region.

We are an official partner of the Malaysian Communications and Multimedia Commission (MCMC) for nationwide IPv6 awareness and have been entrusted by the Malaysian Government to represent the nation at the ITU-T Study Group 20 (IoT, Smart Cities & Digital Twins), where our director chairs Working Group 3 (Numbering & Electronic Addressing).

03 Services Offered

My6 Initiative Berhad provides the following categories of professional services ("Services"):

  • IPv6 Awareness & Promotion: Nationwide campaigns, seminars, workshops, executive briefings, and public education programmes, including those conducted on behalf of MCMC
  • Training & Certification: IPv6 technical training programmes for network engineers, IT professionals, and policymakers; certification preparation and examination support
  • IPv6 Readiness Assessment: Structured evaluation of an organisation's network infrastructure, applications, systems, and human resources readiness for IPv6 deployment
  • IPv6 Deployment: Hands-on implementation consultancy covering dual-stack, IPv6-only, and transition mechanism deployments for enterprise, government, and telco environments
  • Post-Implementation Audit: Independent verification of IPv6 deployments against security, performance, and compliance benchmarks
  • Standards & Guidelines Development: Contribution to Malaysian national IPv6 technical standards, policies, and guidelines; international standards work through ITU-T SG20

Specific terms, deliverables, timelines, and fees for each engagement are governed by individual Service Agreements, Letters of Award, or Purchase Orders issued between My6 and the Client. These Terms apply in addition to, and do not supersede, executed service agreements.

04 Eligibility & Registration

To engage our Services or register for training programmes, you must:

  • Be at least 18 years of age, or be acting with the authority of a legal entity
  • Provide accurate, complete, and current registration and contact information
  • Maintain the security of any account credentials or access provided to you
  • Notify us immediately of any unauthorised use of your account or credentials

My6 Initiative reserves the right to refuse service, cancel registrations, or terminate access at its discretion, including for breach of these Terms or conduct that is harmful to the integrity of our programmes.

05 Service Engagements

5.1 Scope of Work

All consultancy and deployment engagements are scoped through a formal proposal, quotation, or statement of work agreed in writing. My6 will not be responsible for deliverables outside the agreed scope unless a formal scope change is approved in writing by both parties.

5.2 Client Obligations

To enable effective service delivery, Clients agree to:

  • Provide timely access to relevant systems, documentation, and personnel as reasonably required
  • Appoint a designated point of contact for each engagement
  • Ensure that any information provided to My6 is accurate and complete to the best of their knowledge
  • Obtain any third-party consents or approvals necessary for My6 to perform the agreed services

5.3 Government Agency Engagements

For engagements with Malaysian federal or state government agencies, services may be governed by the terms of the relevant MAMPU directive, LOA (Letter of Award), or procurement frameworks. In the event of conflict between these Terms and a formally executed government procurement document, the latter shall prevail.

5.4 Cancellation & Rescheduling

  • Cancellations with more than 14 days' notice: full refund or free rescheduling
  • Cancellations with 7–13 days' notice: 50% of fees apply as a cancellation charge
  • Cancellations with less than 7 days' notice: full fee applies unless My6 agrees otherwise in writing
  • My6 reserves the right to reschedule or cancel engagements due to force majeure, insufficient enrolment, or speaker unavailability — with full refund or alternative arrangement offered

06 Training & Certification

6.1 Enrolment

Training programme enrolment is confirmed upon receipt of a completed registration form and, where applicable, full or partial payment of fees. My6 reserves the right to set minimum and maximum participant numbers for each programme.

6.2 Certification

Certificates of completion or competency are issued based on participation and, where applicable, assessment performance. Certificates issued by My6 Initiative Berhad are the intellectual property of My6 and may not be falsified, altered, or misrepresented. My6 is not responsible for certificates issued by third-party awarding bodies (e.g., IPv6 Forum, ISOC).

6.3 Conduct

Participants are expected to conduct themselves professionally. My6 reserves the right to remove participants whose behaviour is disruptive, offensive, or in violation of applicable laws — without refund.

6.4 Recording & Materials

Training sessions, materials, and presentations are the intellectual property of My6 Initiative Berhad. Recording, reproducing, or distributing training content without prior written consent is strictly prohibited.

07 Fees & Payment

  • Quoted Fees: All fees are quoted in Malaysian Ringgit (MYR) and are exclusive of any applicable taxes (including SST) unless stated otherwise
  • Payment Terms: Standard payment terms are 30 days from invoice date unless otherwise agreed in writing
  • Government Agencies: Payment terms for government clients are aligned with the Government of Malaysia's payment directives
  • Late Payment: My6 reserves the right to charge interest on overdue invoices at the rate prescribed under the Late Payment of Commercial Debts Act (where applicable) or as stated in the service agreement
  • Expenses: Out-of-pocket expenses (travel, accommodation, printing) incurred in delivering services are chargeable at cost unless a fixed-fee arrangement has been agreed
  • Currency: All transactions are in MYR. International clients requiring invoicing in another currency should contact us in advance

08 Intellectual Property

8.1 My6 IP

All content on www.my6.my and all materials, methodologies, frameworks, reports, training content, assessment tools, and standards documents produced by My6 Initiative Berhad are the exclusive intellectual property of My6 Initiative Berhad, unless expressly stated otherwise. This includes but is not limited to:

  • The My6 brand, logo, and name
  • IPv6 readiness assessment frameworks and scoring methodologies
  • Training curricula, slides, workbooks, and e-learning content
  • Audit checklists, compliance templates, and technical guidelines

8.2 Deliverables

Unless otherwise specified in a signed service agreement, reports and deliverables produced for a Client are licensed (not sold) to that Client for their internal use only. Clients may not sub-license, resell, or publicly distribute My6-produced deliverables without prior written consent.

8.3 Standards Work

Documents produced through My6's participation in ITU-T SG20 and other standards bodies are subject to the intellectual property policies of the respective body and are not the property of individual clients.

National Standards

Malaysian national IPv6 technical standards and guidelines co-developed by My6 Initiative are the property of the relevant government body (MCMC / MAMPU / MOSTI) and are published for public use under the terms specified by those bodies.

09 Confidentiality

Both parties acknowledge that in the course of service delivery, each may receive Confidential Information belonging to the other. Each party agrees to:

  • Hold the other party's Confidential Information in strict confidence
  • Use Confidential Information only for the purposes of the engagement
  • Not disclose Confidential Information to any third party without prior written consent, except as required by law or regulation
  • Apply at least the same degree of protection afforded to its own confidential information (and no less than reasonable care)

Confidentiality obligations survive the termination of any service engagement for a period of 5 years, except for trade secrets which remain protected indefinitely. This obligation does not apply to information that is publicly available, independently developed, or lawfully received from a third party.

10 Acceptable Use of Website

When using www.my6.my, you agree not to:

  • Use the website in any way that violates any applicable Malaysian or international law or regulation
  • Transmit unsolicited commercial communications or spam
  • Attempt to gain unauthorised access to any part of the website, its servers, or associated systems
  • Introduce viruses, trojans, worms, logic bombs, or any other malicious or technologically harmful material
  • Scrape, harvest, or otherwise collect data from the website without prior written consent
  • Use automated tools (bots, crawlers) to interact with the website in ways that impose unreasonable load or disruption
  • Misrepresent your identity or affiliation with any organisation when communicating with us

My6 Initiative reserves the right to report any suspected unlawful activities to the relevant Malaysian authorities, including the Malaysia Communications and Multimedia Commission (MCMC) and law enforcement agencies.

11 Disclaimers

The information provided on our website and in our publications is for general informational purposes. While we strive for accuracy, My6 Initiative Berhad makes no representations or warranties of any kind — express or implied — regarding the completeness, accuracy, reliability, or suitability of any information on the website.

  • Technical Guidance: IPv6 deployment recommendations provided in training or awareness materials are general in nature. Specific deployment decisions should be made by qualified network professionals with full knowledge of your environment
  • Third-Party Links: Our website may link to third-party sites (MCMC, MAMPU, IETF, APNIC, ITU). We are not responsible for the content, privacy practices, or accuracy of those sites
  • Availability: We do not warrant that the website will be available uninterrupted or error-free. We may suspend access for maintenance or other operational reasons
  • Standards Documents: References to RFCs, ITU-T Recommendations, and national standards are provided for informational purposes; always refer to the official issuing body for authoritative versions

12 Limitation of Liability

To the fullest extent permitted by Malaysian law:

  • My6 Initiative Berhad's total aggregate liability to you for any claim arising from or related to the use of our website or services shall not exceed the total fees paid by you to My6 for the specific service giving rise to the claim in the 12 months preceding the event
  • My6 shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profit, loss of data, loss of goodwill, or business interruption — even if advised of the possibility of such damages
  • Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by Malaysian law
Note for Government Engagements

Liability terms for services delivered under formal government procurement frameworks (MAMPU, MCMC directives, LOAs) are governed by the terms of those instruments and applicable Malaysian public procurement regulations.

13 Indemnification

You agree to indemnify, defend, and hold harmless My6 Initiative Berhad, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your breach of these Terms or any applicable law or regulation
  • Your misuse of our website, services, or materials
  • Any inaccurate or misleading information you provide to us
  • Any third-party claims arising from your use of our deliverables in a manner not authorised by these Terms

14 Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.

14.1 Amicable Resolution

Both parties shall first attempt to resolve any dispute amicably through good-faith negotiations for a period of 30 days from written notice of a dispute.

14.2 Mediation

If amicable resolution fails, either party may refer the dispute to mediation administered by the Asian International Arbitration Centre (AIAC) in Kuala Lumpur, Malaysia, in accordance with its Mediation Rules.

14.3 Litigation

If mediation fails or is not agreed upon, disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia, with Kuala Lumpur as the seat.

Government Contracts

For government engagements, dispute resolution is subject to the terms of the relevant government contract and applicable Malaysian public sector procurement regulations, which may provide for specific dispute resolution mechanisms.

15 Changes to These Terms

My6 Initiative Berhad reserves the right to modify these Terms at any time. Material changes will be communicated via:

  • A prominent notice on the www.my6.my homepage for 30 days prior to the effective date
  • Email notification to registered clients and subscribers
  • An updated "Last Revised" date at the top of this page

Your continued use of our website or services after the effective date of any revised Terms constitutes your acceptance of those changes. We encourage you to review these Terms periodically.
